What information must I present for recurring payments?

If you offer automatic collection of payments from a payment card (recurring payments), it is important that you inform customers sufficiently about the creation and settings of these payments.

That way you will prevent any misunderstandings on the part of the customer, who will then not be surprised that money is suddenly being taken from their card.

When a recurring payment is created, obtain the customer's consent (e.g. using a checkbox):

  • to the creation and parameters of the recurring payment

  • to the payment details being stored on the GoPay payment gateway's side

At the same time, tell the customer that GoPay handles their payment card data according to the international security standard PCI DSS Level 1 (the highest level of data security in the payment card processing sector).

State the following parameters of the recurring payments in the order form:

  • the reason for creating the recurring payment (e.g. payment for a subscription),

  • the maximum amount of the recurring payment,

  • whether the payment amount is fixed or variable,

  • the period over which the recurring payment will be collected,

  • the date or frequency of collection of the recurring payment,

  • whether the date or frequency of collection is fixed or variable,

  • the specific form of communication the customer can use to change the settings of the recurring payment (e.g. the e-mail address given in the order),

  • information on how to cancel and terminate the recurring payment, or a link to those terms.

Place the parameters of the recurring payment in a visible place (separate from the terms and conditions) where the customer gives their consent to it being created.

💡 GoPay tip: Recurring payments cannot be used to collect instalments in the case of sales by instalments! Such payments have to be handled outside the GoPay payment gateway.

Keep the customer's consent to the creation and parameters of the recurring payment in case you need to prove that the customer agreed to the recurring payment being created (we recommend at least 12 months after the repetition ends).

An order form for creating a recurring payment can look like this, for example:

💡 GoPay tip: Also add information about recurring payments to the terms and conditions of your merchant outlet.

Once the customer has agreed to the creation of the recurring payment, confirm to them within 2 working days that the payment really has been created.

You should also inform the customer at least 7 working days in advance when:

  • you are about to collect the next recurring payment and more than 6 months have passed since the last one,

  • the period during which the customer had your service free of charge has ended and the first recurring payment will be collected from them,

  • there is any change in the settings of the recurring payments (e.g. a change in the frequency of collection).

Once the recurring payment has been created, inform the customer that the payment really has been created.

We also recommend informing customers when a parameter of the recurring payment changes, or if a longer period (e.g. one year) has passed since the last collection of the recurring payment.
