Scope
The PIS rules set out the rules governing the use of the payment initiation service by the GoPay Payment System for its Clients (PIS-GoPay).
Description of the PIS-GoPay service
You become entitled to use the PIS-GoPay service as a function of the GoPay Payment System at the moment you confirm that you agree to these PIS rules.
The payment initiation service (PIS-GoPay) consists in GOPAY, on your instruction, initiating a payment order over the internet to transfer funds from your payment account to another account you specify.
The PIS-GoPay service is intended in particular for paying for goods or services purchased on the internet, or for topping up your personal GoPay account.
GOPAY does not receive funds in order to carry out the payment transaction.
Using the PIS-GoPay service
You acknowledge and accept that the PIS-GoPay service is only one of the functions of the GoPay Payment System and that using it is purely a matter of your free choice.
GOPAY will make your personalised security credentials available only to you and to the party that issued them (usually your bank).
You acknowledge and expressly agree that data about you, with the exception of personalised security credentials, will be shared with the payee. The extent of the data shared is governed by the Privacy policy.
The procedure for using the PIS-GoPay service is as follows:
You create the payment
You give your consent to the use of the PIS-GoPay service
If you are here for the first time or have not used the PIS-GoPay or AIS-GoPay service for a certain period (usually 90 days), you are automatically redirected to your bank's pages to obtain authentication data
You select the account the payment will be made from
You authorise the payment
Immediately after the steps under paragraph 6.4 have been carried out, GOPAY passes the order to carry out the payment transaction to your bank.
Your bank confirms that the payment order has been accepted or refused.
Once the payment order has been received by your bank:
The payment order cannot be revoked
You are provided with information enabling the payment transaction to be identified
You are provided with information about the amount of the payment transaction
You are provided with information about the status of the payment
The fee for the PIS-GoPay service is given in the Fee Schedule, unless agreed otherwise.
You acknowledge that you bear the loss arising from an unauthorised payment transaction:
Up to an amount corresponding to EUR 50, where the loss was caused by the use of misappropriated personalised security credentials
In full, where the loss was caused by your fraudulent conduct or by your intentional breach or gross negligence
Liability for an unauthorised payment transaction outside the cases under paragraph 6.9 is borne by your bank. Your bank is likewise liable for the incorrect execution of a payment transaction carried out contrary to the payment order you submitted through the PIS-GoPay service.
A complaint about an unauthorised or incorrectly executed payment transaction is made with your bank without undue delay after you learn of it, but at the latest within 13 months of the day the relevant amount was debited from your bank account.
Security measures
The PIS-GoPay service may be temporarily deactivated where we come to suspect unauthorised or fraudulent use of the payment instrument or of your personalised security credentials.
The service may also be suspended in other cases that constitute a breach of the Terms and Conditions or of the Security Rules.
Limited availability of the services
The PIS-GoPay service is not available during operational outages or planned maintenance windows.
Final provisions
We are entitled to amend the PIS rules unilaterally according to the rules and conditions set out in this article. You agree to this entitlement.
The PIS rules are issued in electronic form and are available on our website.
Matters not regulated here in the PIS rules are further governed by the PA and the Terms and Conditions.
With any disputes that may arise between us and you when using the PIS-GoPay service, you can also turn to the Financial Arbitrator of the Czech Republic (Czech Act No. 229/2002 Coll., as amended), with its registered office at Legerova 1581/69, 110 00 Prague 1. Your right to turn to the courts is not affected by this; disputes under the Contract are heard and decided before the courts of the Czech Republic, unless mandatory legislation requires otherwise. Disputes between you and us can also be resolved through mediation under Czech Act No. 202/2012 Coll., on mediation.
